Essential requirements to bring out a case of culpable homicide not amounting to murder (Exception to Murder)
Four conditions must be satisfied bring the matter with exception 4 to section 300 IPC
- It was sudden Fight
- there was no premeditation
- the act was done in the heat of passion
- the assailant had not taken any undue advantage or acted in a cruel manner.
All the four mentioned above must be found for culpable homicide not amounting to murder
